Terms of Use

By creating a Capacity account, you agree to these terms and the Privacy Policy. The two most important points: Capacity is training guidance, not medical advice, and Community has zero tolerance for abuse.

Who can use Capacity

Health and safety

Capacity offers general training guidance, not medical advice. It does not diagnose, treat or prevent any condition.

Community

When you join Community, you agree to its rules:

There is zero tolerance for objectionable content or abusive members. We act on every report within 24 hours. We remove content that breaks the rules, and we remove the member who posted it from Community. Some words are blocked automatically, and we may limit how often members post to prevent spam.

You can report any post or comment, and block any member, from its ⋯ menu.

Your content

You own what you post and send. You allow Nolvera Ventures to store it, show it to the people you share it with, and use it to run Capacity. This ends when you delete it or your account, except for copies the Privacy Policy describes. Only post what you have the right to share.

The Privacy Policy explains what we collect, including Apple Health data, and how we use it.

Subscriptions

Our app

Capacity’s software, programs, design and name belong to Nolvera Ventures. You may use the app for your own training on devices you own or control, as the App Store’s rules allow.

Changes and ending

No promises

Capacity is provided “as is.” We don’t promise it will always work, be error-free, or produce any training result.

Limits on our liability

As far as the law allows, Nolvera Ventures is not responsible for any injury, loss or damage from your training or your use of Capacity. If we are found responsible anyway, our total liability is limited to the greater of $50 or what you paid us in the past 12 months. Some places don’t allow these limits, so they may not fully apply to you.

Apple

These terms are between you and Nolvera Ventures, not Apple. Apple is not responsible for Capacity, its content or its support. Apple’s standard license agreement for App Store apps also applies. Apple and its subsidiaries can enforce these terms as third-party beneficiaries.

Disputes

If something goes wrong, email us first and we’ll try to sort it out. These terms are governed by the laws of Washington State, USA, and disputes go to the courts of Washington State.
